Police breaking the arm of an MP found lawful

DİYARBAKIR - The complaint of HDP Batman MP Feleknas Uca whose arm was broken as a result of a police intervention was given the decision of non- prosecution on grounds that the intervention was 'lawful'. The objection Uca's attorneys made was rejected by Batman 2nd Penal Court of Peace.

 
Uca's left arm was broken by the police as a result of the intervention to the reading of a press statement during the hunger strikes on May 13, 2019. Uca's lawyers submitted the medical reports, video footage of the incident and filed a criminal complaint about the relevant law enforcement units to be charged with 'Torture and maltreatment'.
 
Batman Cheif Public Prosecutor's Office declared the decision not to prosecute on grounds that the action was lawful and the intervention was proportional.
 
The application Uca's lawyer Reyhan Yalçındağ made to the Batman 2nd Penal Court of Peace was rejected. The court decided that the prosecutor's office's decision was just and lawful.
 
Uca's lawyer Yalçındağ appealed to the Constitutional Court following the court's rejection decision on grounds that it violates the right to assembly and demonstrations, it violates the freedom to thought and expression and on grounds of the prohibition of torture and ill treatment. Yalçındağ stated that they will apply to the European Court of Humans' Rights in case the Constitutional Court decision is negative.
