Acquittal decision in Temel case overturned: First hearing on 30 May

ŞIRNEX - The acquittal verdict against 3 people in the case of Temer Temel, who was shot in front of his house in Elkê district, was overturned. The first hearing will be held on 30 May.

 
Temer Temel, 50, was shot in front of his house on 7 May 2023 in Sêtkar village of Elkê (Beytüşşebap) district of Şirnex (Şırnak). Temer Temel was the brother of former mayor of Peace and Democracy Party (BDP) Yusuf Temel. The trial of Temer Temel continues.
 
The final hearing on the killing of Temel was held on 6 March at Şırnak 3rd Assize Court. The defendants Lezgin Temel, İskender Temel and Hakkı Temel, who were on trial on the charge of "premeditated killing with blood motivation", were acquitted. 3 names were also released.
 
Temel's lawyers appealed the verdict. The local court's decision was overturned. The first hearing will be held on 30 May at Şırnak 3rd High Criminal Court.
 
'ACQUITTED DESPITE EVIDENCE AND FINDINGS'
 
Temer Temel's son Serkan Temel stated that the court acquitted the defendants despite all the evidence and findings: "During the investigation, the defendants İskender Temel, Hakkı Temel and Lezgin Temel were found to have conversations with each other and with other people about the incident, the defendants talked about the weapon used in the incident and they had many conversations after the incident. Although there were many concrete evidences such as camera recordings, HTS records of their phones and secret witnesses, the court had acquitted the defendants and ordered their release. All legal experts who have analysed the case file say that this decision is against the law. Although there are many concrete evidences in the file, this acquittal decision given by the court is not legal. This situation is clearly against the law, and the court of appeal has recognised that the court did not make a correct and fair decision and this decision has been reversed."
 
SOLIDARITY CALL
 
Temel called for solidarity before the upcoming hearing and stressed: "The first hearing will be held on 30 May at Şırnak 3rd Assize Court. In the first trial, the court clearly sided with the defendants and acquitted them in violation of the law. In this trial, we invite all civil society organisations, especially the Şırnak Bar Association, and all civil society organisations and sensitive groups to attend the hearing and stand by us in order to ensure that the defendants receive the punishment they deserve and that a fair verdict is rendered."
